President and Governor similar legislative powers UPSC Polity


1. The constitutional provision allowing the President of India to appoint any member of Lok Sabha or Rajya Sabha to preside over its proceedings is found in Article 93(1) and Article 104(1) respectively.

2, The President of India nominates 12 members of the Rajya Sabha from amongst persons who have special knowledge or practical experience in literature, science, art, or social service. This is done under Article 80(3) of the Constitution of India.

3. Under Article 171 of the Indian Constitution, the Governor of a state can nominate members to the Legislative Council of the state.

4. Article 103 of the Indian Constitution provides that the President of India decides on questions regarding the disqualification of members of Parliament, in consultation with the Election Commission.

5. The Governor of a State in India decides on questions as to disqualifications of members of the State Legislature in consultation with the Election Commission under Article 192 of the Indian Constitution.

6. The President of India can do the following by virtue of his legislative powers under Article 111 of the Constitution:

(i) give his assent to a bill that has been passed by the Parliament,

(ii) withhold his assent to a bill that has been passed by the Parliament, or

(iii) return the bill (if it is not a money bill) for reconsideration of the Parliament.

The President of India can either give his assent to the bill, withhold his assent to the bill, or return the bill (if it is not a money bill) for reconsideration to the state legislature. This power is derived from Article 200 of the Indian Constitution.

7.Both the President and Governor in India have the power to promulgate ordinances under certain circumstances when Parliament or the State Legislature is not in session, respectively. The President can promulgate ordinances under Article 123 of the Constitution, while the Governor can do so under Article 213. However, ordinances must be approved by the Parliament or the State Legislature within a specific time frame to remain in force.

8. The President of India has the power to make regulations for the peace, progress, and good government of the Andaman and Nicobar Islands, Lakshadweep, Dadra and Nagar Haveli, Daman and Diu, and Ladakh under Article 240 of the Indian Constitution. For Puducherry, the President can make regulations under Article 239A, but only when the Legislative Assembly is suspended or dissolved.

9. Under Article 200 of the Indian Constitution, the governor of a state has the power to give his/her assent to a bill passed by the state legislature, withhold his/her assent to the bill, or reserve the bill for the consideration of the President of India. The governor can exercise these powers when a bill is sent to him/her after it is passed by the state legislature.
